Proposed Rule on Broad Revisions to ITAR and its U.S. Munitions List

The State Department's Directorate of Defense Trade Controls published a proposed rule on October 1, 2026 under Public Notice 13123 that would revise core International Traffic in Arms Regulations definitions and remove several items from the United States Munitions List, following Executive Order 14268 on foreign defense sales. The proposal would clarify the line between controlled technical data and general marketing information, exclude items permanently stripped of military characteristics, loosen the specially designed test, and move most radar altimeters, certain canister launchers and much submersible equipment to the Commerce Control List. It would also exempt temporary exports of foreign-owned defense articles sent abroad for repair. Miller Canfield attorneys advise companies to review affected classifications now and prepare for Commerce controls; the rule is not yet final.

Belarusian Sentenced for Export-Control Scheme to Send US Aircraft Parts to Russia

A federal court sentenced a Belarusian citizen on October 28 to twelve months and one day in prison for violating the Export Control Reform Act, followed by deportation, according to a Justice Department release. Prosecutors said the defendant and co-conspirators in the United States and Armenia bought aircraft components from American distributors and routed them through Armenian companies to Russia without the Commerce Department licenses required, using shell companies, false documents and overseas accounts to hide the destination. The parts were intended for aircraft operated by the defendant's former employer, a company on the Entity List, and the scheme moved dozens of components and millions of dollars. The case illustrates the transshipment patterns and red flags that distributors of controlled aviation parts are expected to screen for.
